針對內政部長李鴻源表示，警方對民眾苗栗大埔抗爭案已完成蒐證，民眾若違法部分不排除移送法辦，國民黨中央政策會執行長林鴻池今（21）日表示，如果真的有違法，就應該依法行政，不過民進黨立委陳其邁則認為，政府根本是用司法當工具進行秋後算帳，只會官逼民反。

不滿苗栗大埔4戶強遭拆遷，由農陣在18日發起「818拆政府行動」，號召萬人上街，活動結束後，部分抗議群眾轉往位於中央聯合辦公大樓南棟的內政部，抗議群眾圍住大門靜坐，在地上噴漆、張貼標語、貼紙，活動持續到19日下午。

林鴻池認為，法律之前人人平等，要視抗爭者是否有實際破壞公物的作為，應該讓證據講話，他強調，如果抗爭民眾沒有違法就不要冤枉人家，但是如果有的話，就依法行政。

陳其邁則認為，立法院曾經針對苗栗大埔案決議要求行政部門必須根據行政院與住戶協商的結論妥善處理土地徵收問題，結果政府沒有依據立院決議執行，還要移送抗爭民眾，民進黨在立法院下會期開議時，將會要求內政部警政署針對執法過當問題進行專案報告。
