頂新三重新燕土地變更案選前引發民進黨質疑新北市長朱立倫圖利財團，新北市政府去年12月2日發新聞稿聲明「終止」該土地開發案。不過被踢爆並未完成相關程序，1月12日新北市城鄉發展局解釋「新燕案採終止辦理，就是讓頂新沒訴願機會，不讓中央政府有核定機會。」

但此說法遭內政部打臉，民進黨立委陳亭妃指出，內政部發函新北市政府要求補正資料，「市府所稱『中央連核定機會都沒有』及『連補都不補』部分，核與法定程序不符，應請該府儘速依上開函復本部，並非由該府逕為終止程序，始為正辦。」

陳亭妃質疑，新燕土地開發案到底是死了還是活案，雙方竟然說法不同，「滅頂行動留一手」。陳亭妃也說，內政部發函同時要求新北市政府1月27日出席內政部都委會會議，針對終止新燕土地變更案的相關理由、細節始末和預計處理方式，希望新北市政府勿再延宕審議時程。
