肇事逃逸跟有沒有喝酒無關

就算沒喝酒車禍後馬上離開事發現場一樣是肇事逃逸

差別在酒後肇事逃逸(刑法會比較重) 還是一般的肇事逃逸

除非他能證明他是在昨晚8點車禍之後才喝的酒
那就不是酒後肇事逃逸罪會比較輕一點
