開房間被抓姦 辯稱研究電視

（中央社記者廖壬楷台中26日電）吳姓男子與人妻到汽車旅館開房間，被人妻老公劉姓男子抓姦。兩人辯稱開房是要研究電視品質，沒有超友誼關係。

劉男於民國101年4月間，發現分居妻子遺留的汽車旅館折價券及2個未使用的保險套，因此找徵信社蒐證，結果抓到妻子與吳男在汽車旅館內使用過的垃圾桶、床單和毛巾，怒告妻子與吳男通姦。

檢方偵辦後，將劉妻、吳男不起訴處分。劉男轉而向法院提起民事求償。

劉妻和吳男在法院審理時辯稱，2人只是同事關係，為了進行網路電視品質的研究，才投宿汽車旅館，並沒有超友誼關係。

台中地方法院認為，雖然毛巾上驗出劉妻和吳男的DNA，但無法認定2人有發生性行為，但2人投宿汽車旅館，已超出正常朋友社交範圍及往來禮節，侵害劉男的丈夫人格身分法益，判決劉妻與吳男要連帶賠償劉男10萬元，全案可上訴。1030626
